Terms of Service

These terms govern your use of AdSafe (the Service), operated by Medware Solutions Pty Ltd (ACN 667 659 985) (we, us). By using the Service you agree to these terms.

1. What the Service is, and is not

AdSafe is an automated screening tool that reviews marketing content you submit against published Australian advertising rules for regulated health services, including section 133 of the Health Practitioner Regulation National Law, Ahpra advertising guidance and TGA advertising restrictions, and produces a risk report.

• The Service provides general information and automated risk screening only. It is not legal advice, and no solicitor-client relationship is created.
• Reports may contain errors or omissions. Automated analysis can miss issues or flag compliant content. You remain solely responsible for your advertising and its compliance.
• We are not affiliated with, or endorsed by, Ahpra, any National Board, the TGA or any government body.
• For formal advice on any finding, consult a qualified legal practitioner or your professional indemnity insurer.

2. Acceptable use

• Only submit content you own, control or are authorised to have reviewed, or content that is publicly available.
• Do not submit personal information about patients or any health information about identifiable individuals. The Service is for marketing content only.
• Do not attempt to disrupt, reverse engineer, scrape or resell the Service without our written agreement.

3. Payments and refunds

Paid reports are one-off purchases processed by Stripe in Australian dollars, with prices shown at checkout. If your report fails to generate, or contains a material processing error, contact us within 14 days and we will re-run it or refund the purchase. Nothing in these terms excludes, restricts or modifies any consumer guarantee or other right you have under the Australian Consumer Law that cannot lawfully be excluded.

4. Intellectual property

You retain all rights in content you submit and grant us a licence to process it to provide the Service. We retain all rights in the Service, including our rule frameworks, report formats and software. Your report is for your internal business use and for sharing with your advisers.

5. Liability

To the maximum extent permitted by law, and subject to the Australian Consumer Law: the Service is provided as is; we exclude all implied warranties; and our total liability for any claim arising from the Service is limited to the amount you paid us in the 3 months before the claim arose. We are not liable for regulatory action, fines, penalties or losses arising from your advertising, whether or not the Service reviewed it.

6. Changes and termination

We may update the Service or these terms; material changes will be posted on this page with an updated date. We may refuse or suspend use that breaches these terms.

7. General

These terms are governed by the laws of New South Wales, Australia, and the courts of New South Wales have non-exclusive jurisdiction. Questions: support@adsafescan.com.au.
